Solar panels and setback distances are the latest to feature in building consent exemption changes.

Changes to Schedule 1 of the Building Act have been introduced, with new two building consent exemptions for roof-mounted solar panel arrays and new setback distance conditions for single-storey detached buildings up to 30 square metres.
These changes aim to:
- make it easier to install roof-mounted solar panel arrays
- make it easier to build single-storey detached buildings, such as sheds, sleepouts and garages
- give building owners more choice about how they use their land
- reduce consenting costs and delays along the way
The new solar panel exemptions allow for roof-mounted solar panel arrays to be installed without a building consent, making it easier for property owners to adopt solar energy.
The Government initially announced the change would be for rooftop solar installations on existing residential buildings. The exemption was later extended to non-residential buildings to support greater uptake of solar power in Aotearoa New Zealand.
The two new exemptions for roof-mounted solar panel arrays complement the existing exemptions for ground-mounted solar panel arrays.
The installation of roof-mounted solar panel arrays needs to be managed appropriately to avoid the risk of affecting the building’s structural integrity and weathertightness.
Although a building consent is not required, building owners still need to comply with the Building Code, local District Plan and the building consent exemption conditions.
The new exemptions are:
- Roof-mounted solar panel arrays that are less than 40 square metres in area and in a wind zone no greater than high.
- Roof-mounted solar panel arrays that are more than 40 square metres in area or in a wind zone greater than high. These must have the design carried out or reviewed by a Chartered Professional Engineer.
Changing setback conditions for exempt buildings
Setback distance conditions for exempted single-storey detached buildings up to 30 square metres in floor area have been eased. This includes garden, tool and bike sheds, garages, small sleep outs, and greenhouses.
The new setback conditions:
- remove the setback distance conditions for buildings under 10 square metres
- reduce the setback to a minimum of one metre for buildings 10 to 30 square metres
Building owners will need to check before starting any building work to ensure their project complies with the local district plan and the Resource Management Act 1991.
